THE STOREYS OF LANCASTER.
Thomas Atkinson makes his mark and mentions his seal. An Inventory accom-panies the
will, which was made 17th November 1694.
An interesting Indenture between John Storey, of Long Greenhead, in Applethwaite, in the parish of Windermere, in the county of Westmorland, and John Mounsey, of Patterdale Hall, in the parish of Barton, in the aforesaid county, may here be introduced. The document refers to certain properties within Troutbeck owned by the Storeys. This Indenture made the First Day of February in the Sixteenth Year of the reign of our Sovereign Lord George the Third over Great Britain France and Ireland King Defender of the Faith and so forth and in the year of our Lord God One Thousand Seven Hundred and Seventy Six Between John Story of Longreenhead in Applethwaite in the Parish of Windermere and County of Westmorland Yeoman of the one part Executor of the last Will and Testament of Richard Story of Browhead in Applethwaite aforesaid which said Richard Story now Deceased was Natural and Lawful Brother of William Story of Longreenhead aforesaid Deceased and Executor of his Real and Personal Effects and John Mounsey of Patterdale Hall in the Parish of Barton and County aforesaid Gentleman of the other part And whereas in and by one Indenture of Sale or Mortgage bearing Date the first Day of February in the Twenty Fifth Year of the Reign of George the Second and in the Year of our Lord One Thousand Seven Hundred and fifty Two and made or mentioned to be made Between Miles Wilson of Lowfold in Troutbeck in the Parish of Windermere aforesaid of the one part and the said William Story of the other part He the said Miles Wilson for the Considerations therein mentioned upon Legal Interest did Grant Bargain Sell Surrender Release and Confirm for and from himself his Heirs and Assigns unto him the said William Story his Heirs and Assigns all those his Closes or Inclosures of Arable Meadow waste and woody Ground with all the Woods and Underwoods Commonly Known by the Names of Low Holbeck Low Grains and Highgrains within the Liberties of Troutbeck aforesaid all which Inclosures of Ground being parcel of the said Miles Wilson's Messuage and Tenement at Lowfold in Troutbeck aforesaid Together with all and Singular Ways Waters Woods and Underwoods Hedges Fences Profits Privileges Hereditaments and Appurtenances whatsoever to the said parcels of Ground or to any part thereof were Incident Belonging or of Right Appurtaining and all the whole Estate Right and Title of him the said Miles Wilson of in or to the same or any part or parcel thereof To Have and to Hold the said parcels of Ground with all and singular the Premises before Granted with the Appurtenances unto the said William Story his Heirs and Assigns and to the only use and behoof of him the said William Story his Heirs and Assigns according to the custom there used and allowed Yielding and paying therefore unto the Lord or Lords of the Fee thereof for the Time being the Yearly Rent of One Shilling and Eightpence fineable and sixpence free at Days and Times accustomed and doing and performing all Dues Dutys and Services Proportionably Due according to the said Custom And that the said Miles Wilson for himself his Heirs Executors and Administrators did Covenant Grant and with him the said William Story his Heirs and Assigns that the said Closes of Ground and all and every the Appurtenances then were be and so at all Times hereafter should continue remain and be unto him the said William Story his Heirs and Assigns for ever free and Clear and freely and Clearly acquitted and discharged or otherwise by the said Miles Wilson his Heirs or Assigns well and sufficiently saved harmless and kept Indemnified of and from all other former Bargains Sales Gifts Grants Mortgages Covenants Charges and Incumberances whatsoever the aforesaid Yearly Rent of One Shilling and Eightpence and Sixpence free and all other Dues and Duties Proportionably Due for the same Excepted and foreprized. Provided nevertheless that if the said Miles Wilson his Heirs Executors Administrators or Assigns should well and Truly pay or cause to be paid unto him the said William Story his Executors or Assigns or any of them the sum of Sixty Three Pounds of Lawful English Money upon the second Day of February then next Ensuing then the said Deed to be Void and of none Effect But upon Default of Payment of the said Sum or any part thereof then the said Deed and the Bargain and Sale therein contained to stand 115
